Terms & Conditions

1. Acceptance of Terms
By downloading, installing, or using Bits (the “App”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the App.

2. Licence
Amitay (“we,” “us,” “our”) grants you a limited, revocable, non-exclusive, non-transferable licence to use one copy of the App on a device you own or control for personal, non-commercial purposes, subject to these Terms.

3. Intellectual-Property Rights
The App—including all software, code, text, graphics, trademarks, and databases—is protected by intellectual-property laws. Except for the licence above, no rights are granted. You may not:

  • copy, modify, translate, reverse-engineer, decompile, or disassemble the App;

  • create derivative works; or

  • remove or alter proprietary notices.

4. Modifications, Updates & Charges
We may add, change, suspend, or discontinue any feature of the App—or begin charging for any App-based service—at any time. We will give clear notice before imposing a fee, and you will not be charged without your explicit consent.

5. Data Sharing with Apple
When you make in-app purchases, you consent to our sharing usage data related to purchased content with Apple solely to facilitate refund decisions, in compliance with Apple’s policies.

6. Privacy
Our Privacy Policy explains how we collect, use, and protect your data. By using the App you acknowledge that processing.

7. User Responsibilities

  • Keep your device and credentials secure.

  • Do not jailbreak or root your device; doing so may expose you to security risks and may render the App inoperable.

  • Ensure you have a reliable internet connection; functionality depends on network availability.

8. Third-Party Fees & Connectivity
Your mobile operator’s data, SMS, or roaming charges may apply. You are solely responsible for such fees and for obtaining any consent from the bill payer.

9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED USD 50 (OR THE AMOUNT YOU PAID US FOR THE APP, IF ANY).

11. Free Features & Trial Access

  1. Always-free core features. The App’s essential functions are permanently available at no cost, with no time limit.

  2. Trial of premium features. Locked or premium features may be unlocked for a one-time free trial period of [x days]. No charges apply during the trial.

  3. Automatic conversion to paid subscription. Unless you cancel before the trial ends, the subscription will automatically start and the applicable fee will be charged through the same platform account.

  4. One trial per user. Free trials are limited to one per person, account, or device. We may refuse, suspend, or cancel a trial we reasonably believe is being abused.

  5. Same licence terms. Use of the App during a trial is subject to all other provisions of these Terms.

  6. Right to withdraw or modify. We may change or discontinue free or trial offerings at any time; active trials will run to completion.

12. Refunds

  1. Digital content is generally non-refundable. Because in-app purchases are delivered immediately, you acknowledge that you lose the statutory 14-day withdrawal right for digital content (Article 16(m) of EU Directive 2011/83/EU and local equivalents) once delivery begins.

  2. Platform-managed refunds. Purchases made through the Apple App Store or Google Play must be refunded through the relevant store’s system. Apple or Google will determine eligibility; we cannot issue direct refunds for those transactions.

  3. Defective or mis-described content. If the App or purchased content is faulty, not as described, or fails to function as promised, request a refund via the same store or by emailing amitay@thegag.club within [30] days of purchase. We will comply with any mandatory consumer-protection laws.

  4. Subscriptions. You may cancel a subscription at any time in your store account settings. Access continues until the end of the current billing cycle; partial-period refunds are not provided unless required by law.

  5. Local consumer rights. Nothing in this section limits any non-waivable rights you enjoy under applicable consumer-protection statutes.

13. Indemnity
You agree to indemnify, defend, and hold us harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the App.

14. Updates & Termination
You must install all available updates to continue using the App. We may terminate or suspend your access to the App at any time without notice. Upon termination, all rights granted to you cease and you must delete the App.

15. Changes to These Terms
We may revise these Terms at any time by posting the updated version in the App or at [URL]. Changes are effective immediately upon posting. Continued use after posting constitutes acceptance.
